Cuelle: “El Aislamiento garantizó el derecho a la salud, pero colisionó con libertades y otros derechos individuales”

El legislador por la Unión Cívica Radical, Marcos Cuelle, también fue consultado a raíz de la editorial del diario La Nación donde se critica el accionar del Estado en estos últimos dos meses. Cuelle reconoció el trabajo que se ha venido realizando desde el gobierno en conjunto con la Cámara de Diputados, aprobando leyes claves para mantener un status privilegiado en salud, pero señaló que en simultáneo se “colisionó con libertades”. También, criticó las “denuncias de violencia institucional por parte de las fuerzas de seguridad”, y recomendó focalizarse “en los ingresos a la provincia con testeos sobre la totalidad de las personas”.

En comunicación con Revista BIFE, Cuelle dijo:

“Claramente vivimos en un mundo que no estaba preparado para afrontar una pandemia, y que ha desnudado estrategias totalmente dispares, que mayormente, a base de información y sentido común, intentan controlar la curva de contagios para no llegar a la etapa de mitigación, donde las personas responsables de la salud, tienen que decidir entre quien vive y quien muere”.

“Argentina no ha sido la excepción, y tempranamente tomo una decisión que inevitablemente significó la confrontación de derechos constitucionales. El ASPO (Aislamiento Social, Preventivo y Obligatorio) garantizó el derecho a la salud, pero colisionó con libertades y otros derechos individuales”.

“En este contexto, La Pampa, a través de diferentes medidas (ratificadas en forma unánime por la Legislatura), estaría manteniendo su status en la etapa de contención, lo que ha significado y significa un enorme esfuerzo de la población, cediendo libertades y derechos individuales en favor de la salud colectiva, incluso el derecho a trabajar y ejercer una industria lícita”.

“Este camino recorrido, permite que La Pampa ingrese a la quinta fase, camino que no estuvo exento de denuncias de violencia institucional por parte de las fuerzas de seguridad y que lamentablemente empañan el esfuerzo que se vino haciendo, además de que podría significar claras violaciones a derechos humanos, y que tendrá que investigar la justicia”.

“Camino que, en aras de garantizar la salud de la población, podría conllevar decisiones que omiten un debate plural, para evitar que sigan colisionando derechos constitucionales, a través de propuestas que podrían ser superadoras”.

“Así, la situación generada por una prohibición absoluta de ingreso en ciertas camineras, desata la astucia de la población para sortear la prohibición, escapando al control del Estado, lo que indudablemente podría significar grietas sanitarias”.

“Ante esta situación, podría ser más conveniente en vez de prohibir, se trabaje en protocolos sanitarios y aperturas administradas, coordinando trabajo entre las localidades lindantes y las fuerzas de seguridad”.

“Además, con una provincia que no tendría contagios comunitarios, es necesario focalizarse en los ingresos a la provincia, con testeos sobre la totalidad de las personas que ingresan, para generar trazabilidad en caso de detectarse la presencia de este virus que nos mantiene en vilo”.

“En resumidas cuentas, es necesario encausar paulatinamente la recuperación plena de libertades y derechos individuales, agudizando las respuestas para que no se generen ASPOs intermitentes, dando por tierra todo el esfuerzo realizado, en primer lugar, por la población; y en segundo lugar por el Estado”.
