El gobernador Sergio Ziliotto instruyó, mediante Decreto nº 1746/20, a la Fiscalía de Estado “para que se constituya en calidad de querellante en la causa judicial originada por la denuncia realizada por el Subsecretario de Salud a raízque tramita por ante el Ministerio Público Fiscal de la Primera Circunscripción Judicial de la Provincia de La Pampa”. El ejecutivo denunció que el pasado 20 de julio dos jueces y un fiscal violaron la cuarentena participando de una cena.
En los fundamentos de la norma firmada en la mañana de hoy se expresa:
“Que, la situación sanitaria en relación a la pandemia conocida como COVID-19 es extraordinaria y sin precedentes;
Que, la Provincia de La Pampa, en consonancia con el Estado Nacional, ha requerido la colaboración de todos los sectores de la Sociedad para resguardar la salud de su población;
Que, la autoridad sanitaria provincial ha realizado un esfuerzo inmensurable para evitar que la pandemia se instale en esta provincia;
Que, se han dictado distintas medidas en resguardo de la Salud Pública de toda la población;
Que, entre dichas medidas por Decreto N° 1134/20 se restringió la circulación interprovincial, pudiendo egresar de la provincia únicamente por razones estrictamente laborales a las localidades limítrofes que no sean “Zonas definidas con transmisión local en Argentina” del COVID 19, siempre que cuenten con autorización individual previa;
Que, por Decreto N° 1375/20, se estableció que las reuniones sociales y familiares solo podían realizarse los días Domingos a Jueves de 8:00 a 20:00 hs y Viernes y Sábados de 08:00 a 24:00 hs;
Que, de acuerdo a la denuncia realizada y legajo judicial iniciado en consecuencia los involucrados se habrían reunido fuera del horario permitido; Que, el Estado provincial no puede omitir el caso teniendo en cuenta la función que desempeñan algunos de ellos, haciendo necesario instruir al Fiscal de Estado a constituirse como querellante en representación de la provincia de La Pampa;
Que, la presencia del Estado Provincial como Querellante puede brindar aún más transparencia al proceso, máxime si tenemos en cuenta que tres de las –hasta ahora 8 personas investigadas- pertenecen a altos cargos del Poder Judicial –mismo Poder- que los investigará y juzgará. (El Dr. Guillermo Sancho es Fiscal General, el Dr. Miguel Vagge es Juez de Faltas y el Dr. Pablo Balaguer es Juez del Excmo. Tribunal de Impugnación Penal);
Que, la supuesta acción desplegada por los imputados reviste de gravedad institucional, lo que justifica la presente querella, que tiene por fin realizar un contralor del proceso, colaborando en la producción de prueba y en el esclarecimiento rápido de la verdad objetiva;
Que, el artículo 101 de la Constitución de la Provincia de La Pampa atribuye al Fiscal de Estado legitimación y personería para intervenir en todos aquellos juicios en los que se controviertan intereses de la provincia, habiéndose reglamentado por la Ley Orgánica de Fiscalía de Estado y Procuración -Norma Jurídica de Facto Nº 888- el modo, atribuciones y los deberes del Fiscal de Estado para la defensa de los intereses de la provincia;
Que, el presente Decreto se dicta en el marco de las atribuciones emergentes del artículo 81 inciso 14) de la Constitución Provincial en tanto faculta al Poder Ejecutivo a “tomar todas las medidas para hacer efectivas las declaraciones, derechos, deberes y garantías de esta constitución…”
