Repaso de los hechos
El crimen ocurrió el 25 de junio del 2019, en una vivienda de General Pico, ubicada en la calle 106 entre 23 y 25. Enzo Gauna, (hasta ese momento nadie sabía de lo ocurrido) había huido unos 96 kilómetros, hasta la localidad de Catriló.
Desde la comisaría de Catriló habían informado que tenían arrestado a un tal Enzo Gauna, 27 años de edad, que supuestamente había cometido un femicidio en Gral. Pico. Acto seguido la policía de Pico acudió a la casa de la víctima y encontraron, en principio, la puerta cerrada, pero con un detalle particular: la llave estaba puesta del lado de afuera. Previamente se solicitó la presencia del juez y fiscales para poder ingresar a la casa. Sin embargo, antes de que lleguen, los uniformados oyeron gritos de auxilios desde el interior. Ingresaron por la puerta principal, donde estaba colocada la llave. Allí se encontraron con los dos hijos de la víctima que recién habían despertado y descubierto, claro, la escena sangrienta de su madre asesinada, tirada al lado de la cama. Los niños tenían 8 y 13 años. La víctima tenía una tercera hijita de 4 años, que para su suerte no se encontraba en la vivienda.
Entonces, según de lo que se puede deducir, Gauna huyó de la casa en la moto de su víctima, hasta la terminal de Ómnibus, donde la abandonó y se tomó un remis hasta Quemú Quemú. Ahí cambió de vehículo y concluyó su huida en Catriló, donde vive su ex pareja con la que tiene hijos en común. En dicha localidad ya se había cambiado de ropa y, en la “intimidad” habría confesado el crimen. Minutos después, lo pasó a buscar un familiar para luego entregarse en la comisaría de Catriló donde confesaría lo sucedido.
Autopsia
Gustavo Ferreyra, encargado del examen post mortem, determinó que Gauna le aplicó 16 apuñaladas en la zona del cuello, 2 en el torso y 2 más en la espalda. “Fue con una violencia tremenda” aseguraron. Incluso uno de los cuchillazos le perforó la tráquea de lado a lado.
María Inés Rapp: pieza importante en el asesinato de Coggiola
El domingo 23, pasado el mediodía (el martes 25 a la madrugada Gauna cometería el crimen) María Inés Rapp, amiga de Valeria Coggiola, mantuvo una conversación vía Whatsapp con el imputado. En dicha conversación Rapp le dijo a Gauna que la víctima se había practicado un aborto, motivo por el cual, según Gauna, la asesinó.
Así habló Rapp: “Él me preguntó si sabía si el hijo era suyo. Yo le respondí que no sabía y que la había acompañado a Valeria en todo el procedimiento. Él me contestó que iba a denunciarla, pero yo le dije que no podía porque había hecho todo por ley. Enzo dijo que le había colmado la paciencia, que estaba cansado de Valeria y que la iba a hacer cagar”
Al día siguiente, lunes 24, Rapp logró contactarse con Valeria telefónicamente y esta última le dijo que había hablado con Gauna y habían decidido hacer un esfuerzo para mejorar la relación y seguir juntos. Más tarde, cerca de las diez de la noche, Rapp fue hasta la casa de Coggiola a busca a la hija más chica para llevársela con ella. Después, cada una en su casa, siguieron conversando vía Whatsapp, sin sospechar de la tragedia que se aproximaba.
En la audiencia la fiscalía le hizo escuchar charlas por Whatsapp entre ella y Gauna. Una fue el 23 de junio a la tarde.
Rapp: Espero que no me decepciones vos también.
Gauna: Lo que se me está pasando por la cabeza es ir a limpiarla… no tengo nada que perder a esta altura.
R: Dejate de joder. Vas a sacrificar tu libertad por tan poca cosa.
G: Pero esa no jode más a nadie.
R: Matala con la ignorancia.
La otra charla fue al día siguiente.
Allí Gauna le contó detalles de lo que había hablado con Valeria sobre el aborto: “Ella me dijo, ¿cómo sabés que era tuyo? Ahí se pisó sola… Si yo ya salía con vos, entonces también salías con el otro… No sé, cada vez pienso más y no lo puedo creer”. Más adelante, siguió: “Me recagaste (sic) a mentiras. Vos te veías con el otro tipo (Pablo) cuando estabas conmigo”.
Esa persona le mandaba mensajes a Valeria porque habían tenido una relación. Pero ella le había contado a Enzo de eso, dijo Rapp
En esa conversación, Gauna insistió con la cuestión del aborto y le dijo a la testigo que viajaría a General Pico para hablar con Coggiola.
Ese mismo día, Rapp también habló con la víctima.
Rapp: Tampoco podés ilusionarlo…
Coggiola: Lo quiero, pero no aguanto que me rompa las bolas. Le planteé que no quería compromiso y le dije que dejé de escribirle (a Pablo) a pesar que lo adoro…
R: Si él quiere algo serio, vos querés todas…
C: Estoy bien, pero lo de los celos no me va, prefiero soltar.
Rapp afirmó que “Enzo era celoso, pero Valeria nunca me contó que la maltratara”.
¿Qué cree que motivó a Gauna a hacer lo que hizo?-preguntó Gómez, defensor de Gauna.
-No puedo creer lo que hizo. No sé qué le pasó por la cabeza… -respondió Rapp.
¿Perpetua para Enzo Walter Gauna?
El fiscal Komarofky, a cargo de los alegatos por parte del Ministerio Público Fiscal, pidió la pena perpetua para Enzo Gauna por el homicidio doblemente agravado de Valeria Coggiola.
Los querellantes particulares, el defensor oficial Alejandro Caram (por Víctor Pérez) y Silvana Abraham (en representación de la Secretaría Provincial de la Mujer), adhirieron a esa solicitud.
Komarofsky encuadró la conducta de Gauna en los artículos 80, incisos 1° y 11° del Código Penal, que justamente –en caso de culpabilidad– prevé solamente la reclusión o prisión perpetua, sin escala media. El primer inciso habla del que matare “a su ascendiente, descendiente, cónyuge, ex cónyuge, o a la persona con quien mantiene o ha mantenido una relación de pareja, mediare o no convivencia”, y el undécimo, cuando matare “a una mujer cuando el hecho sea perpetrado por un hombre y mediare violencia de género”.
La fiscalía sostuvo que el crimen se cometió sobre la cama, apuñalándola fatalmente en el cuello. Además, se agregó, el acusado escondió el celular para que los niños quedasen incomunicados y de esta forma ganar tiempo para huir.
Komarofsky se preguntó “qué hacía un cuchillo de esas dimensiones en ese momento y en ese lugar. Él lo trasladó hasta la mesita de luz. Quería hablar a la noche para estar tranquilo, para actuar en seguro, porque ya le había dicho (a Valeria) que no le jodiera más la vida. Buscó que existiera la menor acción defensiva posible de parte de la víctima”. También confirmó que existía una relación amorosa entre ambos y que actuó en pleno uso de sus facultades mentales. “No existió violencia física, pero sí psicológica; persiguiéndola por su manejo de celular, por sus relaciones interpersonales… Si la supuesta excusa (para matarla) fue que la víctima esperaba un hijo suyo, Gauna era consciente de que tenía otras herramientas para recriminarle el aborto. Podía haber hecho presentaciones en el hospital o en la justicia, pero eligió una conducta cobarde” para asesinar violentamente a Valeria.
Caram adhirió, pero no agregó nada más. En cambio Silvana Abraham, dicho sea de paso es la primera vez que la Secretaria de la Mujer actuó como querellante en un juicio oral, se tomó algunos minutos para recalcar la violencia de género que envolvió el caso.
Así habló Abraham “Gauna cosificó la figura de Valeria. Era celoso, controlador. Creía que ella era de su propiedad, que no podía tener libertad; cuando en realidad eran dos adultos independientes y sin exclusividad en la relación. Entonces, cuando empezó a darse cuenta que el asunto se le iba de las manos, quiso revertir la situación y planificó todo. Porque hubo amenazas previas, ya que dijo que la iba a hacer cagar (sic), después llevó el cuchillo al dormitorio, y al final cerró con llave y dejó a los hijos de Valeria más de tres horas solos con el cuerpo de su madre”.
Abraham cierra del siguiente modo “no se trató de una reacción del momento” y negó que existiera realmente la posibilidad de que entre ambos formaran una “familia hermosa porque eso era un cuento de ángeles”.
Atenuantes
Gómez, el abogado defensor, que no negó la autoría del hecho por parte de su cliente, pidió al tribunal que considere que existieron atenuantes en su conducto (aludió al artículo 81 del Código Penal).
Así habló el abogado: “Tuvo disminuida su capacidad reflexiva y sus frenos inhibitorios. Existió un combo explosivo –detalló–. El embarazo, el aborto, los celos, las mentiras, la desconfianza, la infidelidad… en definitiva, una asimetría entre lo que él quería (con Valeria) y lo que parecía que ella quería con él”.
Y agregó: “Deben ver el corazón, los sentimientos, el honor de Enzo en un momento y una situación determinada. Él era una persona normal, común, sin antecedentes de violencia de género, que vio afectado su estado emocional por todo ese combo”
Gomez concluye diciendo que Gauna no actuó premeditadamente: “Dicen que ocultó el celular para que los niños no pudieran comunicarse, pero lo hizo para que no pudieran salir a la calle…. Dicen que fue todo planificado, pero sin embargo Gauna se llevó un bolso con la ropa ensangrentada, confesó lo que había hecho, se entregó espontáneamente… Fue algo impensado, inesperado, porque se vio afectado su estado emocional. No hablo de inimputabilidad, pero sí de la disminución de la voluntad y por eso pido que consideren las atenuantes”
La sentencia se conocerá este viernes 15 de mayo.
