Una noche, mientras trabajaba como periodista en un diario, me tocó cubrir un hecho. Desde la redacción escuchamos escandalosas bocinas de bomberos, y salimos disparando al Edificio Gemellus, de la calle Urquiza entre San Martín y Lisandro de la Torre, pensando que había un incendio. Al llegar, desde la superficie se podía observar en el noveno piso una luz con un resplandor peculiar, más intenso que cualquier lámpara normal. Los ingenuos, entre ellos la policía y los bomberos, creían que era fuego, pese a que esa ventana no largaba ni una pizca de humo.
¿Qué era esa misteriosa luz que mantenía expectante a los transeúntes y las fuerzas de seguridad de La Pampa? Durante media hora se formularon todo tipo de divagues, hasta que un bombero dijo “no va más, entremos”. De modo que cargaron un zocotroco de hierro semejante a un tronco, y subieron al trotecito por las escaleras. yo, que estaba garroneando información y detalles, pensando que era un vecino al pedo (era un periodista al pedo), fui citado de testigo, entonces subí danzante por las escaleras. Cuando llegamos al noveno piso, los muchachos le apuntaron al centro de la puerta y, pese a que ni un hilito de humo había, le dieron con el mamotreto hasta partirla al medio. Entraron agarrándose de la manguera, miraron para el costado y no había fuego, había un calendario con imágenes de chalas, que decía “martes 30, 12 horas de luz”, “jueves 10, 16 horas de luz”. En la mesita ratona, había un cenicero atestado de tucas al lado de una pipa tan grande que bien se podría haber usado de mamotreto para romper la puerta. En la mesa principal, fertilizante, y más allá, al fondo y al costado, en el lavadero, la misteriosa luz, ¿qué era esa luz?, se preguntaba todavía la policía y los bomberos y la encararon en fila india.
En ese momento, en el preciso momento que la policía descubría las 5 plantas de marihuana perfectamente ventiladas, preciosas, elegantes, sublimes, y con el foco de sodio que las encandilaba, el dueño del departamento llegaba a su morada agitando los brazos y gritando: “¡noo, noo, noo!”. Inmediatamente llegó Toxicomanía para secuestrar las 5 plantas y el fumón, no obstante, quiso persuadir a uno en privado, le dijo “dale, déjame una, qué te cuesta, si no te cuesta nada”, pero el toxicomanómano no cesaba de arrancarlas de cuajo y romperlas y meterlas en una bolsa negra cual cuerpo muerto encontrado en un río oscuro, y éste, el fumón de playa, no paraba de retorcerse cada vez que el policía destripaba una planta, como cuando en las películas una bruja pincha un muñeco y del otro lado del mundo un desgraciado se retuerce. Yo lo miraba a unos metros, con cierta ternura, rodeado de canas que me tiraban alguna data.
¿Qué era esa misteriosa luz que mantenía expectante a los transeúntes y las fuerzas de seguridad de La Pampa?”
Ahí fue que vi uno de sus placares abiertos, y en su interior dos o tres pastillas de éxtasis y una pequeña dosis de LSD con el simpático dibujo del viejito andando en bici “re loco”. “Completito el marihuanero este”, pensé y lo miré fríamente. Él se percató de la desprolijidad de tener el placar abierto y abrió los ojos como un búho y sus testículos le debieron haber empezado a transpirar porque otro policía se encaminaba hacia mí, que estaba al lado del placar de la droga. “Oficial, dígame”, lo detuve, “en qué delito incurrió el joven por la tenencia de marihuana”, y mientras el hombre me explicaba que la causa se girará al Juzgado Federal, y que si verdaderamente era para consumo personal el joven infringió la ley 23.737, yo empujaba suavemente la puerta del placar hasta cerrarla, y el porrero me agradecía con la mirada extraviada, haciendo un solemne ademán con la cabeza. La crónica “formal” en el diario se puede leer acá.
Cuando terminó el operativo, le dije al joven “que mala leche tenés, quién habrá sido el demente que confundió fuego por una luz de sodio”. Me respondió “sisi, pero esto no hubiera pasado si la marihuana fuera legal”.
En el preciso momento que la policía descubría las 5 plantas de marihuana el dueño llegaba a su morada agitando los brazos y gritando: “¡noo, noo, noo!”
Es el debate que se viene. Más allá de las organizaciones y agrupaciones sociales que presionan desde hace años para que el consumo de marihuana se legalice, el tema quedó definitivamente instalado con la asunción del nuevo gobierno nacional, que prometió un proyecto para despenalizar la tenencia y el autocultivo (click). También, hubo fuerte polémica por las declaraciones del ministro de Seguridad de la provincia de Buenos Aires -Sergio Berni-, quien propuso legalizar todas las drogas; y la ministra de Seguridad de la nación, quien opinó empezar por la marihuana y después “ver” si se avanza con el resto de las drogas.
Pese a que está sobre la mesa de las discusiones en el país y en Occidente, en La Pampa aún sigue siendo un tema tabú. O por lo menos se perciben ciertas reticencias a la hora de hablar del asunto por parte de quienes están en lugares donde se toman decisiones. No obstante, el ministro de Seguridad de la provincia, Horacio di Nápoli, en una larga entrevista que concedió a Revista BIFE (puede leerse acá), sin esquivar la pregunta, opinó que está “de acuerdo con la legalización si tenemos un Estado responsable”, aunque consideró que es la “puerta de entrada de otras drogas”. En otra entrevista, el ministro de Salud, Mario Kohan, (se lee acá), dijo: “Yo creo que si distribuimos alegremente la marihuana va a ser una nueva puerta de entrada para posteriormente avanzar en otro tipo de sustancia. No creo que haya que facilitar cualquier puerta de entrada al consumo problemático. Tampoco soy de los tipos que les gusta prohibir las cosas”, aunque manifestó que “está abierto al debate”.

¿Qué opina hoy cada presidente de bloque de la Cámara de Diputados, donde en un futuro cercano se debatirá y se legislará al respecto?
Francisco Torroba, presidente del Bloque del radicalismo –propone estudiar más el tema, pero advirtió que es la “puerta de entrada” de drogas duras-:
“Yo creo que el tema de la marihuana no es inocua. En su momento estuve a favor del tema de la regulación del cannabis medicinal. Tiene que ser objeto de un debate. Nosotros tuvimos una reunión en Luiggi con nueve localidades. Hicimos un análisis socioeconómico y político del funcionamiento de esa región. Entre el análisis salió el tema de la droga. Y habría un avance a las drogas más blandas que mutan en drogas más duras. Hoy no me animaría a opinar sin saber qué opina la gente de Salud. Lo que sí creo que no es inocuo el consumo y que hay una tendencia a que las drogas blandas sean previas a las drogas duras”.
Sandra Fonseca, presidenta de Comunidad Organizada –en contra de la legalización del cannabis para consumo personal-:
“La posición del Bloque Comunidad Organizada es la que hemos sostenido siempre. No estamos de acuerdo con la legalización de drogas. Sí estamos de acuerdo con el uso medicinal del cannabis con la prescripción médica correspondiente, que solo está determinada por la evidencia científica. No adherimos al uso recreativo de la marihuana, donde hay sobrada evidencia científica que es nociva para la salud de los propios consumidores. No estamos de acuerdo con el autocultivo, pues no se puede producir cannabis medicinal, porque se necesita de un procedimiento que no está al alcance de cada ámbito domiciliario. La obligación del Estado en sus tres niveles (nacional, provincial y municipal), de acuerdo a la ley nacional 27350 es difundir para conocimiento de la población los alcances y aplicación de la Ley Vigente e incluso garantizar la accesibilidad a las obras sociales en el caso de su uso medicinal”.
Julio González, presidente del bloque Frejupa –como bloque no tienen una posición formada y esperan al debate-:
“La postura de nuestro bloque se conocerá cuando se instale el debate acá. La posición que tendremos será cuando lo discutamos con todo el gobierno. Es un tema sensible que requiere debate, y no tiene que se definido por una sola cartera. Te diría que quien tiene que omitir opinión primero y decir qué sucede es el Ministerio de Salud. Mi opinión es esperar el debate, y que defina mi bloque y mi gobierno”.
Martín Ardohain, presidente del bloque PRO –no quiere opinar sin saber, prometió estudiar el tema pero aún no respondió.
“Disculpame pero quiero estudiar sobre la temática, no quiere opinar livianamente. Muchísimas gracias, y gracias por la paciencia”. Fue la escueta respuesta del macrista Ardohian cuando se le consultó hace unas dos semanas. Luego, ante la insistencia de BIFE no volvió a responder.
