Extienden las licencias para empleados públicos con hijos menores de 14 años

El Gobierno nacional dispuso hoy el otorgamiento de licencias hasta el 21 de mayo para trabajadores del sector público con niños, niñas o adolescentes de menos de 14 años que deban realizar escolaridad virtual, en las zonas que se encuentren en alarma epidemiológica, en el marco de las restricciones vigentes por la segunda ola de la pandemia del coronavirus en el país.

Por medio de la Decisión Administrativa 463/2021, firmada por el jefe de Gabinete, Santiago Cafiero, y publicada hoy en el Boletín Oficial, se prescribe que podrán disponer esas licencias cualquiera sea la forma de vinculación jurídica de prestación de servicios de carácter laboral y/o personal con el sector público nacional.

Los beneficiarios deben encontrarse a cargo de niños, niñas o adolescentes de menos de 14 años que deban realizar escolaridad virtual y se encuentren inscriptos en establecimientos educativos de todos los aglomerados urbanos, departamentos o partidos que se encuentren en situación de Alarma Epidemiológica y Sanitaria.

Se aclara que para asistir niños, niñas y adolescentes con Certificado Único de Discapacidad (CUD) a cargo de dicho personal no regirá el límite de menos de 14 años.

Además, se indica que “la licencia podrá ser solicitada por la o el agente, y en la medida que se encuentre declarado el vínculo con los niños, las niñas y los y las adolescentes en sus legajos personales”.

En esa línea, se señala que las licencias deben encuadrarse “por razones de fuerza mayor o bien efectuar un encuadramiento análogo según el régimen de licencias, justificaciones y franquicias aplicable al personal de cada organismo”.

También se especifica que «en el supuesto de que ambos progenitores convivientes presten servicios en el sector público nacional, la justificación se otorgará solo a uno de ellos o una de ellas».

Finalmente, en la decisión administrativa se invita «a adoptar medidas similares al Poder Judicial, al Poder Legislativo, a las provincias y a la Ciudad Autónoma de Buenos Aires, y a los municipios que se encuentren en situación de Alarma Epidemiológica y Sanitaria.

Entre los fundamentos de la medida, se expresa que la misma se dicta ante la suspensión de clases presenciales para los aglomerados urbanos, departamentos o partidos que se encuentren en situación de alarma epidemiológica y sanitaria dispuesta por el decreto Decreto N° 287/21.

De esa manera, se busca “facilitar la compatibilización de la integridad familiar que en este marco de emergencia implica también el apoyo a la escolaridad virtual, resulta imprescindible otorgar licencia a uno/a de los/las progenitores/as convivientes, tutores/as y/o curadores/as, en la medida en que presten servicios en el sector público nacional”.
