El Superior Tribunal de Justicia aprobó la creación de una Comisión de Ética del Poder Judicial y, de esa manera, La Pampa pasó a ser la segunda provincia que cuenta con una norma de esas características.
La Comisión tendrá como función principal “asesorar y evacuar consultas referidas a la interpretación y aplicados” de los preceptos contenidos en el Código Modelo Iberoamericano de Ética Judicial, y estará conformada por tres miembros designados por el STJ. Uno de ellos será propuesto por los colegios o asociaciones que nucleen a magistrados y funcionarios del Poder Judicial; “debiendo asegurarse la diversidad de géneros en su integración”.
La decisión fue adoptada por el presidente del cuerpo, José Roberto Sappa, y el resto de los ministros, Eduardo Fernández Mendía, Hugo Oscar Díaz, Elena Victorica Fresco y Fabricio Luis Losi, a través del acuerdo 3747.
El texto estipula que las facultades serán las siguientes: a) evacuar consultas formuladas por los integrantes del Poder Judicial, sobre interpretación y aplicación de preceptos éticos consagrados en la parte I del “Código Modelo Iberoamericano de Ética Judicial”, en relación a casos concretos; b) promover la difusión y participación en foros de discusión en materia de principios de ética judicial; c) proponer al Superior Tribunal de Justicia acciones o reformas normativas en materia de principios de ética judicial; y d) dictar su propio reglamento de organización y funcionamiento interno.
El STJ ya había adherido, por intermedio del acuerdo 3408 al Código Modelo, que impone a magistrados y funcionarios desempeñarse con “independencia e imparcialidad, transparencia, prudencia, diligencia y responsabilidad, cortesía e integridad, entre otros aspectos”.
“Dichos principios –señala la acordada firmada hoy– sintetizan una serie de exigencias dirigidas a los magistrados y funcionarios judiciales, a quienes se les requiere, en miras del mejoramiento del servicio de justicia y teniendo en consideración las posibilidades fácticas y jurídicas, la mejor conducta posible en los procesos en los que intervienen (…) El acatamiento de dichas exigencias otorga (…) mayor legitimidad y autoridad en su actuar, posibilitando la excelencia judicial”.
Los tres miembros titulares de la Comisión –como así los tres suplentes– durarán tres años en sus funciones y podrán ser designados por un período más. Para ello se requiere ser magistrado, en servicio activo o jubilado, del Poder Judicial y sus tareas serán ad honorem. Sus dictámenes no serán vinculantes y tampoco excluyentes de “cualquier tipo de proceso de determinación de responsabilidad por el actual judicial” (por ejemplo, civil, penal, administrativo, disciplinario).
Cuando la Comisión reciba alguna consulta sobre interpretación y aplicación de principios éticos en un caso concreto, deberá emitir su dictamen en un plazo máximo de 30 días hábiles.
Con esta iniciativa, La Pampa pasa a ser la segunda provincia en contar con una comisión o tribunal de ética propio, ya que hasta ahora solamente Córdoba contaba con un organismo de consulta para magistrados y funcionarios.
