La Cámara de Apelaciones en lo Civil, Comercial, Laboral y de Minería de Santa Rosa dictó más sentencias que causas ingresadas durante 2019.
Esta tendencia favorable se mantiene desde 2017, de esta manera por tercer año consecutivo, se dictaron más sententencias que causas ingresadas.
Datos interesantes.
- Las controversias sobre competencia entre jueces de primera instancia se mantuvieron altas, representando el 10 por ciento de las resoluciones totales interlocutorias.
- Las resoluciones por recusaciones o excusaciones en 2019 se quintuplicaron.
- Las apelaciones directas (por ejemplo, expedientes relacionados con la Ley de Defensa del Consumidor) disminuyeron cuatro veces, pasando del 12 por ciento el año pasado, al 3 por ciento.
- En los procesos relacionados con Derecho del Trabajo, los conflictos por relaciones individuales (despidos) y controversias remuneratorias se mantuvieron igual. En los últimos años la Cámara viene manteniendo la siguiente relación: una de cada tres sentencias corresponde al fuero laboral.
- Las causas por accidentes de trabajo se duplicaron, pero continuaron representando valores porcentuales bajos.
- Las apelaciones por daños y perjuicios en juicios contra el Estado no mostraron cambios de tendencia.
- Las apelaciones por resarcimiento en accidentes de tránsito mostraron un incremento notable del 50 por ciento con respecto a los valores del año anterior.
- Un detalle interesante es que los casos por simulación se duplicaron. Ellos se refieren a declaraciones ficticias de voluntad, buscando generalmente fingir actos o contratos con el fin de perjudicar a un tercero.
La Cámara de Apelaciones de la Primera Circunscripción Judicial fue presidida este año por el juez Guillermo Samuel Salas, quien será continuado en 2020 por Marina E. Alvarez. Para el año próximo las tres salas quedarán conformadas por las juezas M. Alvarez y Laura Torres (Sala 1), Adriana Gómez Luna y Fabiana Beatriz Berardi (Sala 2) y G. Salas y la jueza Laura Cagliolo (Sala 3).
