A pesar de la resistencia de los inquilinos del país, el decreto de congelamiento de alquileres y prohibición de desalojos, vigente durante un año por la pandemia, concluirá este miércoles, por lo cual el Gobierno puso en marcha esta semana un protocolo para asistir a las familias con problemas habitacionales.
Tras un año de congelamiento de los alquileres, medida que se tomó en el marco de las medidas económicas de emergencia por el coronavirus, a partir del 1 de abril los contratos podrán actualizarse y las familias que hayan acumulado deuda deberán acordar planes de pago de hasta 12 cuotas contemplados en la normativa o enfrentar juicios de desalojo.
Este martes, la Federación de Inquilinos Nacional realizó un “ruidazo inquilino” en distintos puntos del país “para denunciar el abuso del mercado inmobiliario por los aumentos de precios y las condiciones cada vez restrictivas para poder acceder a una vivienda en alquiler”.
Asimismo, la manifestación apuntó a “pedirle al Gobierno que extienda el decreto que suspende los desalojos para evitar una crisis habitacional, social y humanitaria en el medio de la segunda ola”.
Por otra parte, sostienen que es necesario implementar un “plan de desendeudamiento de las familias inquilinas” y el “control para el cumplimiento efectivo de la ley de alquileres vigente desde hace 10 meses”.
A principios de marzo, el ministro de Desarrollo Territorial y Hábitat, Jorge Ferraresi, anticipó a Télam la no extensión del decreto y afirmó que a partir de abril “no habrá posibilidad de desalojos sin mediación”, una instancia que se creó en la nueva Ley de Alquileres.
Además, el Gobierno implementó la obligatoriedad de registrar los contratos de alquiler en AFIP, lo cual de no cumplirse es un impedimento para el propietario en caso de querer avanzar en un desalojo.
Un protocolo para casos de desalojo
Por otra parte, esta semana se creó el “protocolo de riesgo temprano de desalojo” con el objetivo de asistir a las familias que se encuentren en situación de desalojo ante el inminente vencimiento del decreto.
A través de la Resolución 88/2021, se instruyó la elaboración y aprobación del Protocolo Nacional de Alerta Temprana de Desalojos de Vivienda Única y Familiar en Regímenes de Alquileres Formales.
Se establecerán los criterios de priorización de las personas, teniendo en consideración a las familias monoparentales, en situación de violencia de género, a las personas con discapacidad, mayores o en situación de vulnerabilidad, entre otros.
Al respecto, el secretario de Desarrollo Territorial, Luciano Scatolini, remarcó a Télam que “esta decisión representa un Estado sensible que no mira para el costado ante una circunstancia que todos deseamos que no se produzca, que tiene que ver con el desalojo de familias”.
“Vamos a trabajar en articular el esfuerzo del Estado en revertir esta situación habitacional a partir de una oferta de viviendas, y mientras tanto tener una respuesta, con un protocolo con pasos concretos, para atender la situación de cada familia y dar una solución habitacional a partir del financiamiento que el Estado hace de los programas de viviendas”, señaló Scatolini.
Explicó que se hará “un relevamiento de información fehaciente de sentencias que se podrían llegar a ejecutar, con un criterio de prioridad de situaciones de mayor vulnerabilidad”, y agregó que “también vamos a realizar un relevamiento con las unidades ejecutoras de soluciones habitacionales de todo el país que arman el listado de adjudicatarios de viviendas para que dentro de esos listados se priorice a personas en situación de desalojo”.
