Este domingo 12 de septiembre 34.330.557 ciudadanos deberán acudir nuevamente a las urnas para las PASO. Allí, se definirán los candidatos de cada frente electoral, que competirán dos meses después, el 14 de noviembre, en las elecciones generales.
La veda comenzó a regir a las 8 de este viernes, es decir, 48 horas antes al inicio de las primarias abiertas, simultáneas y obligatorias (PASO) del domingo, con algunas restricciones que se extenderán hasta tres horas después del cierre de los comicios…las 21 horas del domingo.
De acuerdo con el Código Nacional Electoral en ese plazo no se podrán “realizar actos públicos de proselitismo y publicar y difundir encuestas y sondeos preelectorales”. La medida alcanza tanto a los precandidatos y dirigentes como a los medios de comunicación.
Además de no estar habilitada la posibilidad de hacer actos de campaña el Código Electoral Nacional también prohíbe la realización de espectáculos y la venta de bebidas alcohólicas desde las 20 horas del sábado 11 de septiembre hasta las 21 horas del domingo.
Tampoco se puede “ofrecer o entregar a los electores boletas de sufragio dentro de un radio de ochenta metros de las mesas receptoras de votos”. Asimismo, está prohibida “la portación de armas, el uso de banderas, divisas u otros distintivos durante el día de la elección, doce horas antes y tres horas después de finalizada”.
En tanto, los espectáculos populares al aire libre o en recintos cerrados y toda clase de reuniones públicas que no se refieran al acto electoral, como obras de teatro, no podrán realizarse durante el desarrollo de los comicios y hasta pasadas tres horas luego de ser clausurados, es decir hasta las 21 del domingo 12 de septiembre en esta oportunidad.
Respecto al uso de las redes sociales durante la veda electoral, solo son validas las publicaciones interpersonales y está prohibida la publicidad formal para captar votos sin embargo es un ámbito muy complejo de controlar y las publicidades continúan apareciendo a través de cuentas de usuarios individuales o falsas.
Cualquier violación a la normativa prevista por el Artículo 71 del Código Nacional Electoral, deberá ser denunciada y quien la cometiera podría llegar a ser sancionado por la Justicia, si se comprobara la irregularidad.
Si los partidos políticos no cumplen el período de la veda perderán el derecho a recibir contribuciones, subsidios y todo recurso de financiamiento público anual por un plazo de entre uno y cuatro años. También dejan de percibir fondos para el financiamiento de una o dos elecciones.
Además, si no se respetan los límites de emisión y publicación de avisos publicitarios en televisión, radios y medios gráficos, se contempla una multa. Lo mismo para la persona que realice actos de campaña fuera del plazo establecido para ese fin.
