12 años de cárcel para un hombre que abusó sexualmente de su media hermana

El juez de audiencia sustituto de General Acha, Raúl Miguez Martín, condenó hoy a 12 años de prisión, por el procedimiento de juicio abreviado, a un hombre de 73 años por ser autor del delito de abuso sexual con acceso carnal, agravado por resultar el imputado medio hermano de la víctima y por haber aprovechado la situación de convivencia con ésta cuando era menor de 18 años -al momento en que comenzaron los hechos-; como delito continuado. Los hechos fueron enmarcados en la ley 26485 de Protección Integral a las Mujeres.

La pena acordada entre el fiscal achense, Juan Bautista Méndez, y el defensor oficial Marco Daniel Mezzasalma –conjuntamente con el acusado, que admitió la autoría de los hechos– es la más alta que se permite convenir en un abreviado, de acuerdo a la última reforma del Código Procesal Penal de La Pampa. En este tipo de salidas alternativas, el juez no puede imponer sanciones más severas a las requeridas por el Ministerio Público Fiscal.

Con las pruebas reunidas, Miguez Martín dio por probado que el imputado abusó sexualmente de una media hermana desde que el padre de ambos falleció. Las agresiones fueron cometidas desde que la víctima tenía 15 años y hasta octubre pasado. Como consecuencia de esos abusos fueron concebidos tres hijos. La damnificada no pudo denunciar antes los hechos por haber sufrido durante todo ese tiempo “violencia de tipo sexual, física, psicológica y económica en el ámbito intrafamiliar”, detalla el fallo.

El juez, además, le mantuvo al acusado la prisión preventiva –con modalidad domiciliaria– ordenada oportunamente en un domicilio de Santa Rosa, hasta que la sentencia quede firme. Una vez que ello ocurra deberá ser detenido inmediatamente para dar cumpliendo al fallo.

También en ese momento deberá ser incluido en el Registro de procedimiento y notificación de antecedentes de condenados por delitos contra la integridad sexual.
