Una trabajadora de YPF Serviclub, que se encontraba en forma tercerizada a través del call center ACC Group falleció por COVID. Esto ocurrió luego de que la obligaran a realizar tareas presenciales bajo amenaza de despido, que durante la pandemia prestó mediante teletrabajo. El hecho sucedió el pasado 25 de enero.
Sin ser trabajadora esencial y pudiendo trabajar en forma remota, Gladys Livias «fue expuesta al no tenerse en cuenta protocolos vigentes, condiciones de seguridad e higiene y al usar el transporte público, incumpliendo la patronal la obligación de ocuparse del traslado. Todo ello bajo la amenaza de perder su fuente de trabajo.», explicaron desde el cuerpo de delegados del call center.
En este sentido informaron que llevaron adelante “desde el comienzo de la pandemia presentaciones en la justicia laboral y, con el acompañamiento del Sindicato de Empleados de Comercio, denuncias en MTEySS, GCBA, MPF, SRT y medidas de fuerza, pero no fue suficiente para frenar las irregularidades que tuvieron un fatal desenlace, así como otros contagios que en el ámbito laboral, a raíz del contacto estrecho con la compañera fallecida.”
La empresa “cliente” ahora quiere desentenderse y pone en riesgo la continuidad laboral de los trabajadores que todavía prestan servicios para ella. Los delegados aseguraron que YPF “pretende no continuar otorgando trabajo al call center, dejando en una situación de absoluta incertidumbre a los trabajadores, muchos de los cuales ya fueron despedidos con causas inventadas para ahorrar el pago de indemnizaciones. A su vez, desconoce cualquier responsabilidad sobre el caso y ha anunciado que declinará el diálogo que mantenían a través del Ministerio de Trabajo.”
En este marco, los trabajadores pidieron “que los organismos competentes tomen cartas en el asunto, para evitar que esta situación continúe y poder proteger la salud y las fuentes de trabajo.
