El Tribunal de Impugnación Penal anuló una sentencia absolutoria en un caso de estupro calificado, por haber ocasionado un grave daño en la salud física de la víctima (una menor de 13 años). Para ello argumentó una razón técnica: declaró la invalidez de la acusación fiscal “por inexistencia de correspondencia entre el relato del hecho contenido en la acusación frente al hecho históricamente ocurrido y reconstruido en el juicio oral”.
¿Qué significa en los hechos? Que en el debate oral se comprobó que lo ocurrido (abuso sexual coactivo) resultó mucho más grave que la acción por la que el acusado fue llevado a juicio (estupro). Para ello el TIP argumentó que de las pruebas producidas en el juicio se constató que la preadolescente nunca prestó consentimiento.
El caso había sido llevado a juicio con un relato de los hechos bajo la figura de estupro calificado. Es decir, un abuso sexual en el que el autor se encuentra en una posición de superioridad, prevalencia o prerrogativa frente a una persona mayor de 12 años y menor de 16 y donde hay un aprovechamiento de la inmadurez sexual que se manifiesta a través de conductas tendientes a lograr el consentimiento de la víctima.
Lo que hizo la Sala B, conformada por el juez Fernando Rivarola y la jueza María Eugenia Schijvarger, fue no hacer lugar al recurso de impugnación interpuesto por el fiscal Marcos Sacco –pidiendo la condena del imputado por estupro–, remitió el proceso a la fiscalía competente y ordenó la nulidad de la acusación.
Tras el juicio oral, el juez de audiencia santarroseño, Andrés Olié, había absuelto al imputado también por un defecto técnico: afirmó que se hallaba “impedido de efectuar una modificación de la calificación jurídica” sostenida por Sacco y, por lo tanto, debía “disponer la absolución del acusado por no adecuarse la conducta atribuida al tipo penal contenido en el artículo 120 del Código Penal”.
Ocurrió que el Ministerio Público Fiscal acusó por ese artículo (estupro agravado), al entender que existió consentimiento de la menor para mantener relaciones con el acusado –aunque adujo que el agresor se aprovechó de la inmadurez sexual y de relación de preeminencia respecto de la víctima y que, además, le produjo lesiones graves–; mientras que Olié consideró que se trató lisa y llanamente de un abuso sexual con acceso carnal porque no hubo consentimiento. Para ello se basó en el relato de la menor, en Cámara Gesell, que habló directamente de “violación“.
Olié dictó esa resolución basándose en el artículo 344 del Código Procesal Penal de La Pampa. El texto señala que “la sentencia solo podrá dar por acreditados hechos o circunstancias contenidos en la acusación” y añade que el juez no podrá en fallo, darle al hecho “una calificación jurídica distinta a la de la acusación, salvo que sea en beneficio del imputado y que la defensa haya tenido posibilidad de refutarla”.
Revisión integral.
La Sala B en voto conjunto se detuvo en el análisis acerca de si hubo o no consentimiento de la menor al momento del acto sexual porque si no el estupro se convierte en un abuso sexual coactivo. Remarcó que no solo la víctima negó haber prestado consentimiento, sino que la psicóloga forense calificó su relato como “creíble y no fabulado” y además los informes médicos constataron las lesiones.
A su vez, del testigo presencial que se valió el fiscal para hablar de consentimiento, el TIP afirmó que era amigo del imputado y agregó que su testimonio contuvo “fisuras que no pudieron ser saturadas” por el Ministerio Público Fiscal.
En base a una mirada integral de las pruebas, Impugnación concluyó que “durante el juicio se acreditó un hecho muy distinto al contenido en la acusación fiscal” y que lo que se probó en el debate “es coincidente” con lo dicho por Olié. Asimismo, al evaluar lo actuado por la fiscalía en la etapa previa al juicio, el Tribunal sostuvo que ya en la denuncia y en la primera formalización surgió que “el hecho ocurrió con violencia”, agregando que desde allí en adelante no apareció otra prueba “que haya podido hacer variar la acusación”.
La Sala dijo que “el acusador público se apartó de los hechos denunciados y del propio relato de la víctima, y realizó un recorte de la trama fáctica incompatible con lo ocurrido en la realidad (…) Por eso decimos que la acusación sobre cuya base el imputado fue llevado a juicio describió un hecho distinto del que ocurrió históricamente y que se acreditó en el debate”. O sea que el acusado fue llevado a juicio por un hecho distinto al acontecido.
Sin garantías vulneradas.
Otra cuestión que el TIP evaluó fue la garantía del principio “non bis in ídem” (una persona no puede ser juzgada nuevamente por el mismo hecho). La defensa planteó que luego de un juicio oral no es posible “retrotraer a etapas precluidas del proceso” porque si no se estaría violando esa garantía.
Frente a ese argumento, Rivarola y Schijvarger respondieron que debían realizar “una prueba de equilibrio” entre los derechos de la mujer víctima de violencia sexual y la garantía del “non bis in ídem” –ambos con raigambre en el derecho constitucional e internacional de los derechos humanos– y definir “cuál sería el interés preponderante”.
En tal sentido, la Sala B manifestó, basándose en fallos del Superior Tribunal de Justicia, que “si no hay sentencia firme, no hay afectación del ‘non bis in ídem'” y acotó que “para que esta garantía se considere vulnerada deben haberse respetado las formas sustanciales del juicio“, entre las que está la acusación fiscal. “Frente a una acusación inmotivada, que realizó un recorte tal de la trama fáctica que implicó llevar a juicio un hecho que no fue el históricamente acontecido, no podemos sostener que se cumplió con las formas esenciales del juicio”, acotó.
Por último, Rivarola y Schijvarger pusieron un ejemplo muy gráfico para avalar esa decisión. Explicaron que “una práctica de esa naturaleza” (un recorte tal de la trama fáctica) no es permitida cuando se presenta un acuerdo de juicio abreviado, ya que si ello ocurre el juez que lo controla no puede convalidarlo. “No sería coherente sostener que aquellos limites que el Ministerio Público Fiscal nopuede traspasar en el marco de un juicio abreviado, podrían ser dejados de lado cuando presenta una acusación para debate”, concluyó el Tribunal.
