Un hombre fue condenado porque amenazó a su expareja con difundir fotos íntimas de ellas. La sentencia fue dictada por el juez de control de General Acha, Diego Ariel Asin, quien le impuso una pena de dos años de prisión en suspenso como autor del delito de coacción.
El conflicto penal se resolvió por el procedimiento de juicio abreviado, convenido entre la fiscala de 25 de Mayo, Eugenia Paola Bolzán, la defensora oficial Nydia Conde y el propio imputado, de 32 años. El hecho fue enmarcado en la ley 26485 de Protección Integral a las Mujeres.
Con las pruebas reunidas durante la investigación fiscal preparatoria, el magistrado dio por probado que el 16 de marzo pasado, el acusado “envió capturas de fotos, mediante su teléfono celular, a su expareja, en el que estaba en ropa interior; manifestándole que las iba a hacer públicas”.
Las partes también acordaron que el acusado deberá cumplir con las siguientes pautas de conducta: fijar residencia, someterse al cuidado del Ente de Políticas Socializadoras, abstenerse de concurrir al domicilio de la víctima ni entrar en contacto con ella, y realizar un tratamiento psicológico.
Las pruebas que tuvo en cuenta Asin, entre otras, para probar el delito fueron un informe técnico de la Unidad Funcional de Género, Niñez y Adolescencia (acta de allanamiento y secuestro de un celular), fotografías e informes de la Oficina de Atención a la Víctima y a los Testigos y de un psicólogo forense.
En los abreviados, el juez no puede imponer sanciones más gravosas que las requeridas por el Ministerio Público Fiscal, tal cual lo establece el Código Procesal Penal.
