Comienza a funcionar el “Modelo de Gestión Judicial Común”, aseguran que los procesos serán más ágiles y rápidos

Hoy lunes se puso en marcha, en el Poder Judicial de La Pampa, el  “Modelo de Gestión Judicial Común”, una iniciativa que permitirá seguir profundizando la oralidad y la digitalización de los expedientes, darle más celeridad a los procesos civiles y, además, otorgarle una mayor previsibilidad a los propios abogados.

¿Por qué esta reforma permitirá alcanzar esos objetivos? Porque los juezas y los juecesestarán dedicados exclusivamente a resolver cuestiones jurisdiccionales y no también administrativas. Eso significa que solamente se preocuparán por el dictado de sentencias y resoluciones y de las audiencias preliminares y de vista de causa. Y también porque se fijarán criterios únicos para la presentación de escritos por parte de los profesionales y de providencia por parte de los tribunales.

En principio, el “El Modelo de Gestión Común” se implementará en dos juzgados civiles,  comerciales y de minería de la Primera Circunscripción Judicial, con asiento en Santa Rosa. Serán el N° 1 y el N° 4, a cargo de las juezas Susana Ethel Fernández y Ana Lis Palacio, respectivamente.

Por eso ambas vinieron trabajando, en forma conjunta, en los últimos meses para reacondicionar el funcionamiento interno de ambos tribunales, ya que debieron readaptar al personal –que dejará de pertenecer a un juzgado específico y pasará a formar parte de una especie de Oficina Judicial Civil– y los espacios físicos.

Justamente, en el nuevo modelo, el personal será dividido en cuatro grandes unidades de gestión. La Unidad de Atención, una suerte de mesa de entrada virtual única, estará a cargo de la recepción y control de expedientes; la Unidad de Admisión y Seguimiento de juicios voluntarios se encargará de tramitar las causas donde hay una sola parte (sucesiones, restricciones de capacidad, etc.); la Unidad de Admisión y Seguimiento de procesos contenciosos se dedicará a los expedientes contradictores, es decir donde hay más de una parte; y la Unidad de Gestión de Audiencias tendrá que organizar, controlar y efectuar un seguimiento de las audiencias preliminares –en las cuales se promueven conciliaciones– y las de vista de causa, donde se incorporar las pruebas y puede alegarse, antes del dictado de la sentencia.

Ambos tipo de audiencias tienden a la oralidad y en las segundas el magistrado/a tendrá la posibilidad de dar a conocer su fallo inmediatamente a su conclusión, luego de conocer las pruebas y oír los alegatos de las partes. Esta opción es facultativa para los profesionales.

Con estas modificaciones las secretarias  y la prosecretaria y el prosecretario de los dos juzgados pasarán a ser los responsables de cada una de las cuatro unidades de gestión.

Para la implementación del proyecto se contó, y seguirá contando, con el respaldo de la Secretaría de Sistemas y Organización para la adecuación del uso de la tecnología a esta nueva realidad en el ámbito civil.

La iniciativa fue aprobada por el Superior Tribunal de Justicia a través del acuerdo 3789.

El STJ se valió para ello de las recomendaciones brindadas por el del Centro de Estudios de Justicia de las América (CEJA), un organismo internacional del sistema interamericano, con autonomía técnica y operativa, que tiene como misión apoyar los procesos de reforma y modernización de los sistemas de justicia en las Américas.
