El fiscal federal Ramiro González imputó este lunes al expresidente Mauricio Macri por el supuesto ocultamiento de parte de su patrimonio cuando llegó a la Presidencia de la Nación -un delito vinculado en el Código Penal al de enriquecimiento ilícito-, en el marco de la denuncia presentada la semana pasada por la Oficina Anticorrupción (OA).
El representante del Ministerio Público Fiscal, que tiene delegada la investigación, dio impulso a la denuncia y dispuso las primeras medidas de prueba, según informaron a Télam fuentes judiciales.
La Oficina Anticorrupción, en su denuncia, había acusado al expresidente de protagonizar movimientos accionarios entre sociedades ficticias y socios inexistentes para dar “apariencia” de legalidad a dinero que pudo haber sido conseguido de forma espuria.
La denuncia, elaborada a instancias de un informe confeccionado por la Inspección General de Justicia (IGJ), alertaba además sobre la posibilidad de que el exmandatario hubiera incurrido en los delitos de enriquecimiento ilícito y lavado de activos.
La maniobra denunciada por la OA, que encabeza Felix Crous, incluía movimientos accionarios que involucran a las sociedades AGRO G S.A., Latin Bio y hasta al Fideicomiso Ciego de Administración, que Macri suscribió con la firma Seguridad Fiduciaria S.A. cuando asumió la Presidencia con el fin de desentenderse del manejo de parte de su propio patrimonio.
En ese sentido, el fiscal González consideró pertinente solicitarle a la Inspección General de Justicia la copia de distintos documentos relativos a la firma Agro G (Agropecuaria del Guayquiraró), como así también requerirle a la OA que facilite la declaración Jurada Patrimonial Integral de Macri correspondiente a los años 2015 y 2016.
Según surge de la denuncia, Macri mintió cuando declaró poseer el 14 por ciento de las acciones de AGRO G, cuando en realidad tenía el 20 por ciento, y omitió además haber adquirido la titularidad de más de 5 millones de acciones preferidas de la firma, hecho que quedó en evidencia cuando, sin haber declarado previamente su titularidad, las transfirió al fideicomiso ciego.
“Corresponde imputarle a Mauricio Macri la transferencia de al menos $ 5.064.938 provenientes de un ilícito penal, con los que adquirió la titularidad de 5.064.938 de acciones preferidas de la firma Agro G S.A., la que se habría concretado entre el 02/09/13 y el 12/04/16, con la doble finalidad de otorgarle apariencia de licitud al dinero espurio invertido, y que éste genere futuros dividendos también aparentemente lícitos”, se indicó en la denuncia.
Corresponde imputarle a Mauricio Macri la transferencia de al menos $ 5.064.938 provenientes de un ilícito penal”, precisa la denuncia
Las maniobras “consistieron en omitir deliberadamente la comunicación a la IGJ del aumento de capital social resuelto el 02/09/13, y de asentar en los libros de acciones la titularidad de las 5.064.938 acciones preferidas, se conjugan con la conducta concretada por el propio Mauricio Macri, consistente en omitir maliciosamente la declaración de su real tenencia accionaria en dicha sociedad en la Declaración Jurada Patrimonial correspondiente al año 2015, presentada ante esta Oficina Anticorrupción”, se relató.
Macri se alzó -según surge del texto de la denuncia- con la suma de 54.286.824 pesos “resultando el único socio de Agro G S.A. que retiró dividendos en los últimos 10 años, mientras el resto de los accionistas consentían dicha situación, que ocurría tanto cuando los resultados de los ejercicios anuales arrojaban ganancias, como cuando representaban quebrantos”.
“No puede soslayarse que los $ 54.286.824 fueron transferidos en concepto de dividendos por la firma Latin Bio S.A., cuyos accionistas mayoritarios son Agro G S.A., titular del 29,75% del capital social, y Juliana Awada, cónyuge de Mauricio Macri, quien resulta titular del 20,25% de dicho capital”, según se indicó en la denuncia.
Además, se informó que, entre quienes conformaron el directorio de Latin Bio S.A, se encuentran el exsecretario de Legal y Técnica de la presidencia de Macri, Pablo Clusellas; y Alejandro Jaime Braun Peña y Luz Braun Peña, primos segundos del exJefe de Gabinete Marcos Peña, según se denunció.
De la lectura completa de la denuncia, que cayó en manos de la jueza María Servini, se desprende que Macri se habría transferido a sí mismo más de 50 millones de pesos entre 2017 y 2020, “lo que constituye otra clara maniobra de lavado de activos nacida de la compra con dinero espurio de las acciones preferidas de Agro G S.A”.
