El concejal Mariano Rodríguez Vega y la secretaria de Desarrollo Económica, Carmina Besga, presentaron el registro voluntario de usuarios, usuarias y cultivadores para uso medicinal.
“El Registro es voluntario, de usuarios, usuarias, cultivadores e investigadores que tiene como finalidad evitar penalización para las personas que quieren hacer uso del cannabis medicinal”, dijo la secretaria de Desarrollo Económico, Carmina Besga.
“Hay que entrar al sitio web (https://cannabis.santarosa.gob.ar) y registrarse, es muy intuitivo”, agregó Besga, para aclarar que los roles de la policía provincial y federal no cambia. “Este registro es una herramienta más, para afrontar un caso judicial. La ordenanza no se mete en el funcionamiento interno de las fuerzas policiales. Es un registro voluntario. Nosotros acompañamos la demanda social en seguir ampliando derechos, orientados al uso medicinal del cannabis”.
Por su parte, Mariano Rodríguez Vesga manifestó su emoción ante la creación del Registro. “Quiero agradecer la decisión tomada por el intendente cuando le planteamos y propusimos esta ordenanza, que nos permitió avanzar con el respaldo político necesario”.
“También agradecer a la Secretaria de Desarrollo Económico en la creación de este registro y a cada uno de los usuarios, cultivadores, familiares y organizaciones acá presentes, que colaboraron el armado de la ordenanza, para lograr el consenso en el Concejo Deliberante”, dijo Mariano Rodríguez Vega.
Cabe recordar que el proyecto contempla también la creación de un Consejo Consultivo de Cannabis Medicinal, del que participarán usuarios y familiares, profesionales, Universidades, ONGs y miembros del Legislativo y el Ejecutivo local. El concejal había anunciado la iniciativa a principio de año e hizo hincapié en la urgencia de brindar un marco legal para los usuarios y usuarias de cannabis que cultiven en sus casas, como sucedió en el caso de una ordenanza sancionada en San Antonio Oeste y Las Grutas.
El proyecto de ordenanza estableció un marco regulatorio voluntario en el ámbito de la Municipalidad de Santa Rosa para la registración de personas usuarias de Cannabis con fines medicinales, terapéuticos, de investigación médica y científica, garantizando y promoviendo el cuidado integral de la salud.
Crea en el ámbito del Municipio de Santa Rosa el Registro Voluntario de Personas Usuarias y Cultivadores de Cannabis Medicinal y sus derivados el cual oficiará como banco de datos para la producción y clasificación de información. Los usuarios se inscribirán declarando las patologías padecientes con la debida certificación médica junto con las especificaciones que correspondan a su cultivo, con el resguardo y protección de identidad adecuada, garantizando la confidencialidad de la información sensible consignada por personas que integren dicho registro enmarcado en la Ley Nacional 25326 de Protección de Datos Personales.
Además, se crea un Consejo Consultivo de Cannabis Medicinal de carácter interdisciplinario, conformado por usuarios y familiares de Cannabis Medicinal, profesionales referentes de la temática, miembros del poder legislativo y ejecutivo, Universidades y miembros de ONG´s a los fines de brindar transparencia y garantizar el derecho de los ciudadanos al acceso a la salud.
En su carácter de órgano de consulta de la autoridad de aplicación, son funciones del Consejo Consultivo de Cannabis Medicinal: a) Asesorar en la elaboración de normas y disposiciones atinentes a la materia; b) Colaborar, en forma previa a su aprobación, en la elaboración de los planes y programas; c) Impulsar el desarrollo de las investigaciones médicas y científica, del uso medicinal terapéutico y/o paliativo del dolor de la planta de cannabis y sus derivados con el objetivo de garantizar y promover el cuidado integral de la salud; d) Promover el desarrollo y las previsiones para el Registro creado en el artículo 3° de la presente Ordenanza; e) Promover programas de capacitación y difusión en relación a la temática de la presente Ordenanza, a través de jornadas públicas y capacitaciones; f) Opinar fundadamente en toda otra cuestión relacionada a la materia, que le fuera requerida por la autoridad de aplicación o cuando lo estimare conveniente.
Finalmente, el proyecto establece que el municipio promoverá acciones de divulgación informativa que favorezcan la concientización acerca del uso medicinal del aceite de cannabis y sus derivados, los que podrán estar orientados a profesionales de la salud, las ciencias, así como al público en general, las que resultaran referidas al conocimiento de la planta de cannabis y sus beneficios en la salud, así como la producción de aceite de cannabis en cultivo personales y domiciliarios con fines medicinales, entre otros.
En los fundamentos de la iniciativa, el autor explicó que “el registro que se crea mediante la presente ordenanza será instrumentado mediante una plataforma informática a la que tendrán acceso las personas usuarias, con reserva de identidad, generando la registración documentada y voluntaria de información en la situación clínica, sanitaria, variedades de consumo, frecuencia y dosificaciones y cualquier otro dato que se considere de importancia».
