Una madre fue condenada hoy a seis meses de prisión en suspenso, por haberle provocado –como consecuencia de su conducta negligente– quemaduras con agua caliente a su bebé de cinco meses.
La sentencia fue dictada por el juez de control santarroseño, Carlos Matías Chapalcaz, como consecuencia de un acuerdo de juicio abreviado presentado por el fiscal Walter Antonio Martos, el defensor particular Maximiliano Cheli y la propia imputada, una ama de casa de 33 años que admitió su responsabilidad.
¿Cuáles fueron los hechos? Haber ocasionado que, por un accionar negligente, el pequeño sufriera, cuando tenía cinco meses, quemaduras de segundo y tercer grado en el antebazo derecho, al cáersele agua caliente sobre él. Lo ocurrido fue valorado en el marco de la ley 26061 de Protección Integral de los Derechos de las Niñas, Niños y Adolescentes.
El delito por el que la mamá fue condenada a seis meses de prisión de ejecución condicional fue el de lesiones culposas –prevé sanciones de un mes a tres años de prisión o multa–; a la par que se le fijaron –por ser la pena en suspenso– reglas de conducta de cumplimiento obligatorio durante dos años: a) fijar residencia y someterse al cuidado del Ente de Políticas Socializadoras, con la frecuencia que ese organismo lo determine; b) someterse a un tratamiento psicológico, el cual podrá realizar en el ámbito público o privado, debiendo acreditar esta circunstancia mediante certificados pertinentes, hasta la finalización de las reglas de conductas y/o la obtención del alta; y c) abstenerse de realizar cualquier trato violento, discriminatorio, vejatorio, humillante y/o intimidatorio respecto del bebé.
La asesora de Niñas, Niños y Adolescentes, Graciela Massara, al ser notificada del abreviado, se opuso porque si bien los términos del acuerdo se modificaron con relación al texto original, se reeditaron circunstancias que habían llevado a los profesionales de la salud –que actuaron en un primer momento en la atención de la víctima–, a exigirle a las autoridades judiciales y administrativas “la mayor previsión con respecto de las medidas que le garantizaran al niño, no solo la asistencia en materia de salud, sino también la asistencia por parte de adultos responsables”.
Massara no convalidó el recorte que se hizo de los hechos, ni el carácter culposo de la conducta de la madre; y, por el contrario, señaló que lo que pasó no se trató de algo “fortuito o de un accidente”, sino de maltrato infantil.
La denuncia que promovió la investigación fiscal fue presentada por una médica y una trabajadora social del hospital Lucio Molas. Chapalcaz, al dicta el fallo, evaluó, entre otras pruebas, ese texto, fotos de las lesiones e informes médicos,
“Más allá de la oposición de la asesora de niñas, niños y adolescentes al acuerdo de juicio abreviado presentado por las partes, y de los fundamentos brindados en tal sentido; advierto que la calificación propuesta se corresponde con el hecho imputado, resultando lógica y razonable”, indicó el juez.
“Claramente, la fiscalía, dentro del marco de su exclusiva competencia, hizo uso de las facultades que le otorga el propio Código Procesal Penal, que imposibilita el avance jurisdiccional sobre tal aspecto (…). El artículo 368, inciso 1) establece que ‘… el rechazo no podrá fundarse en recortes fácticos o probatorios que el fiscal haya realizado conforme estrategias de persecución penal, pero que guardan correspondencia, aunque sea parcialmente, con ciertas proposiciones fácticas’”, agregó.
“Lo cierto es que, en relación al hecho en concreto formalizado e imputado por fiscalía, y que es objeto del acuerdo de juicio abreviado, no surgió evidencia que acreditara su carácter doloso”, concluyó Chapalcaz.
