Un adolescente de 18 años fue condenado a tres años de prisión de cumplimiento efectivo por ser autor de los delitos de robo agravado por escalamiento, violación de domicilio, robo simple en grado de tentativa, hurto simple en grado de tentativa (en dos ocasiones) y encubrimiento por receptación dolosa, en cinco causas diferentes.
Además se le decretó la autoría y la responsabilidad respecto de un robo simple y un robo agravado en grado de tentativa, por ser de un vehículo dejado en la vía pública –ya que esos delitos los cometió siendo menor– y se dispuso remitir los dos expedientes al Juzgado de la Familia, Niñas, Niños y Adolescentes .-
Como Walter Emiliano Arce gozaba del beneficio de la suspensión a prueba –o probation– hasta el 8 de marzo de 2022, y antes de cumplirse esa fecha volvió a delinquir, el juez de control santarroseño, Carlos Ordas, se lo revocó a pedido de las partes en el marco del juicio abreviado en el que dictó la sentencia. Ese acuerdo fue presentado ante el magistrado, en forma conjunta, por el fiscal Andrés Torino, la defensora oficial Silvina Blanco Gómez y el propio imputado.
La seguidilla de hechos delictivos de Arce, ya siendo mayor, comenzó el 31 de enero pasado cuando, junto a otro joven, entraron a una vivienda de la calle Paraná –sin ejercer fuerza ni violencia–, a las seis de la mañana, y se llevaron 950 pesos, un taladro y dos cadenitas de fantasía. Incluso llegaron a dejar un televisor de 50 pulgadas en la puerta, pero no pudieron llevárselo porque fueron sorprendidos por la damnificada.
Menos de una hora más tarde, a las 6.45, Arce, forzando una reja externa, sustrajo de un comercio de la calle Donatti tres botellas de Martini, una de vodka, una lata de cerveza y una bandeja con sanguches. Los hechos fueron cometidos junto a otra persona.
A su vez, se comprobó que tenía en su poder –en su propio domicilio– una moto marca Honda, modelo Bizz, que había sido sustraída el 17 de febrero de un depósito de la calle Entre Ríos. La propia madre de Arce fue quien entregó el vehículo.
El 7 de marzo, a media mañana, el acusado sustrajo un par de zapatillas del patrio trasero de un domicilio de la calle Alemania. Las tenía puestas cuando fue aprehendido por la policía.
A las 96 horas, y en compañía de Raúl Omar Sotelo, luego de saltar un tapial de dos metros de altura y dañar una puerta, Arce robó 15.000 pesos, una mochila, un reloj, anillos, pulseras, dos parlantes portátiles, una bolsa con ropa de mujer nueva –que estaba para la venta–, remeras, pantalones y calzados deportivos de primeras marcas, gorras y dos remeras de River. El hecho ocurrió entre las 15 y las 17 en una vivienda de la calle Buenos Aires. Sotelo pidió que le otorguen la probation.
Ese mismo día, a las 18.30, el imputado –sin permiso de la propietaria– saltó otro tapial para ingresar a un inmueble de la calle Tito Fuertes. Cuando la damnificada advirtió que estaba en el patio, Arce volvió a salta el tapial y huyó.
Con respecto a los delitos cometidos siendo mejor, un hecho ocurrió el 6 de diciembre pasado, cuando robó una moto Honda Wave 110 que estaba estacionada en la calle Toscano y, minutos después, la policía lo interceptado cuando circulaba en ella.
También se probó que –después de forzar una reja– ingresó a una casa de la calle Calegaris y sustrajo 4.500 pesos, una computadora, una notebook, una play station, auriculares, una guitarra, un micrófono inalámbrico, un juego de cubiertos de plata, dos relojes pulsera para hombre y dos para mujer, dos parlantes chicos con bluetooth y varias mochilas.
