Un padrastro de 33 años fue condenado hoy a nueve años de prisión por ser autor de los delitos de abuso sexual simple de una menor de 13 años, agravado por haber sido cometido contra una menor de 18 años aprovechando la situación de convivencia preexistente y además por ser encargado de la guarda; en concurso real con abuso sexual gravemente ultrajante por las circunstancias de su realización, agravado por haber sido cometido contra una menor de 18 años aprovechando la situación de convivencia preexistente y además por ser encargado de la guarda.
Los hechos fueron enmarcados en las leyes 26485 de Protección Integral a las Mujeres y 26061 de Protección Integral de los Derechos de Niñas, Niños y Adolescentes, y la víctima fue una hija de la pareja del imputado. Además el juez de audiencia santarroseño, Carlos Besi, le dictó la prisión preventiva al padrastro y ordenó su detención inmediata hasta la finalización del proceso.
Justamente el proceso se llevó adelante en el marco de las restricciones establecidas por el crecimiento de contagios de Covid-19 en Santa Rosa y en la provincia, ya que el Poder Judicial no ha dejado de trabajar ni de cumplir con su labor de brindarle un servicio de justicia eficiente a la comunidad pampeana.
Con las pruebas reunidas durante el juicio oral, Besi dio por acreditado que el imputado, sin precisar fecha, pero entre los años 2015 y 2016, y cuando la niña tenía siete u ocho años, abusó sexualmente de ella en dos oportunidades en la vivienda familiar y aprovechando que la progenitora iba a trabajar y él se quedaba al cuidado de la menor.
Para fijar la pena –de acuerdo a los delitos iba de 8 a 20 años–, el juez valoró favorablemente que el acusado no tuviera antecedentes penales, su edad, colaboración y predisposición durante el proceso, su postura y presencia en las audiencias y que siempre mantuvo la actividad laboral y se procuró su propio sustento.
En cambio tuvo en cuenta como agravantes el daño causado a la menor y su extensión, afectándose su integridad sexual; a tal punto que las secuelas de hechos se mantienen en la actualidad. Además, dijo Besi, el acusado vulneró gravemente su integridad sexual su hijastra, encontrándose en pleno proceso de formación de su personalidad. Otros agravantes fueron la modalidad y ocasión de los abusos, ya que el agresor “actuó en la clandestinidad, aprovechando el momento y la ocasión para llevar adelante su accionar, como así la ausencia de terceros”.
Finalmente, Besi le impuso la pena que habían requerido el fiscal Cristian Casais y la defensora oficial, María Silvina Blanco Gómez, actuando como querellante particular en representación de la madre de la víctima, ya que los jueces están impedidos de fijar penas superiores a las requeridas por el Ministerio Público Fiscal.
