La Justicia prohibió el uso de la marca “Maradona”, la cual quedó en poder del abogado Matías Morla, para a ser usada en cualquiera de sus formas o seudónimos y en todas partes del mundo.
Es en una causa iniciada por Giannina y Dalma Maradona por presunta defraudación luego que la empresa Sattvica S.A. de Morla, inició “un total de 147 solicitudes de registros de marcas relacionadas con Maradona (nombre, pseudónimos e imagen) ante el Instituto Nacional de Propiedad Intelectual (INPI)”.
“Si bien formalmente la empresa no estaba impedida de hacerlo, no deja de ser un aspecto a subrayar la ocasión elegida para iniciar tamaña cantidad de solicitudes de registro de nuevas marcas vinculadas al nombre, pseudónimo o imágenes representativas de Diego Armando Maradona, pese a que éste último ya había fallecido y existían numerosos procesos judiciales iniciados por conflictos entre el accionista mayoritario de aquella sociedad y los herederos del nombrado ex deportista”, sostuvo el fiscal Carlos Donoso Cástex, lo que derivó en la medida ordenada por el juez de instrucción 43.
Ante lo dictaminado por el fiscal, el juez decidió “ampliar la orden de prohibición de innovar y contratar” todas las solicitudes de marcas “relacionadas con el nombre, los pseudónimos y la representación de la imagen de Diego Armando Maradona, en todas sus variantes (denominativa, figurativa y mixta), en particular las que actualmente están en trámite ante el INPI”.
En su decisión, el juez dispuso comunicarla a Morla y al presidente de Sattvica S.A. que la prohibición pesa “se encuentren o no en territorio de la República Argentina”.
La prohibición implica también para la utilización de marcas bajo el seudónimo “Diego Maradona”, “Diego”, “Diegol”, “Maradona”, “Diego Armando Maradona”, “La Mano de Dios” o “El 10”, junto con las imágenes utilizadas. Inicialmente, el juzgado había dispuesto el allanamiento del estudio jurídico de Morla y ordenó la prohibición del uso de la marca “Sattvica”.
La firma Sattvica S.A fue armada por Morla el 11 de junio de 2015 y según la denuncia de las hijas de Maradona no era otra cosa que un “sello de goma” para apropiarse de todas las marcas” del astro del fútbol y negarse a devolverla a sus propietarios.
