La jueza de audiencia de juicio María José Gianinetto condenóa Matías Osvel Montello, de 30 años por el delito de “privación ilegal de la libertad agravada por haber sido cometida con amenazas y violencia”y “tenencia de arma de fuego de uso civil sin la debida autorización legal”; a la pena de cuatro años de prisión y mil pesos de multa.
El hecho que conmocionó al pueblo, ocurrió en la localidad de Arata, la tarde del 22 de abril de 2020, cuando dos menores de 11 y 3 años se encontraban jugando en el patio de su casa y escucharon el pedido de auxilio de una persona. Al acercarse, Montello las apuntó con un arma, las amenazó y las llevó del lugar a unos 40 metros, en un campo cercano, allí las retuvo y les dijo que se quedaran quietas y calladas, agachadas. Al intentar levantarse una de las niñas, Montello la tomó del hombro y le rompió la remera. Asimismo, en un allanamiento posterior el día 23 de abril, en su domicilio, Montello tenía en su poder un arma de uso civil, sin la autorización correspondiente para ello.
En su alegato de clausura la fiscalía solicitó que se condene a Matías Osvel Montello a la pena de cuatro años de prisión y multa de $1000. El representante de la querellante particular adhirió a lo solicitado por la fiscalía. Por su parte, la defensasolicitó la absolución de su defendido.
La jueza expresó en el fallo que “sin dudas estamos ante un caso particular y para nada habitual, por tratarse de la desaparición de dos pequeñas niñas del patio de su casa en manos de un extraño, que causó gran alarma en la pequeña localidad de Arata, donde muchos vecinos se movilizaron espontáneamente para buscar o preguntar por las niñas”.
“Lo cierto es que gracias al rápido accionar de la madre advirtiendo la ausencia de sus hijas a los pocos minutos, de las vecinas llamando a la policía y publicando la situación en las redes sociales, la policía y hasta la presencia de Bomberos -haciendo sonar su sirena en señal de emergencia-, la situación terminó rápidamente. La niña expresó que el hombre se puso nervioso cuando escuchó la sirena de Bomberos y finalmente en ese momento las dejó ir, quedando la duda de qué es lo que hubiera sucedido si las niñas hubieran podido traspasar el alambrado del campo, tal como quería el acusado”, agregó la magistrada.
Como agravantes, Giannetto tuvo en cuenta que se trató de dos víctimas,” cuyas vidas se han visto afectadas a partir de ese momento, también considero que se trata de niñas que tienen toda la vida por delante, y que deberán aprender a convivir con las secuelas que este hecho les dejó”. Asimismo, consideró como agravante que el imputado “ aprovechó a su favor para cometer el delito la vulnerabilidad e indefensión de dos niñas de corta edad, que sabía no podrían resistirse a su voluntad, máxime si consideramos la utilización del arma de fuego, lo que incrementaba el peligro que las niñas corrieron y el amedrentamiento que sufrieron (…) el acusado eligió justamente a estas dos niñas, entiendo en razón de su género y por su edad”.
El juicio se desarrolló del 1 al 5 de febrero con la coordinación de la magistrada.Asistieron al mismo el defensor particular Martín Herrero Galvagno, el fiscal Juan Ignacio Pellegrino, y representando a la querellante particular –madre de las dos menores damnificadas- el defensor oficial Alejandro Piñeiro.
