A través del procedimiento de juicio abreviado, la jueza de control santarroseña, María Florencia Maza, condenó hoy a un joven de 22 años a seis meses de prisión en suspenso por ser autor del delito de lesiones leves calificadas por la relación de pareja, en concurso real con amenazas simples, en dos causas distintas, y le dictó una restricción de contacto y acercamiento con la víctima.
El abreviado fue convenido, y presentado ante la magistrada, por la fiscala Verónica Ferrero, la defensora oficial Silvina Blanco Gómez y el imputado Juan Fernando Córdoba, quien admitió la autoría de los hechos. La madre de la damnificada, al ser informada sobre sus alcances, también dio su consentimiento.
Además, al acusado se le fijaron reglas de conducta que deberá cumplir durante dos años, bajo apercibimiento en caso de incumplimiento de revocarle la condicionalidad de la condena: a) fijar domicilio del que no podrá ausentarse sin autorización de la autoridad judicial; b) someterse al contralor del Ente de Políticas Socializadoras; abstenerse de entrar en contacto con la víctima, no pudiendo acercarse a menos de 200 metros del lugar donde se encuentre, ni de su domicilio; ni pudiendo entrar en contacto con ella de manera personal, por interpósita persona, ni por ningún otro medio; y d) realizar un tratamiento psicoterapéutico.
¿Cuáles fueron los hechos? Uno de ellos ocurrió el 4 de octubre del año pasado, cuando tras discutir con su pareja de 16 años en el frente de la casa de la madre de ella, “Córdoba, ofuscado, tomó del cabello a la víctima, le hizo caminar unos pasos y le dio una patada en un muslo, causándole lesiones”, según detalló el fallo. En ese momento, al oír gritos, la madre de la menor se dirigió hacia el agresor y le dijo que se retirara.
Horas después el imputado regresó, volvió a discutir con su pareja, propinándole dos cachetadas en el rostro y tomándola del cabello, aunque sin causarle lesiones.
El segundo hecho ocurrió al día siguiente cuando Córdoba contactó a la damnificada por la red social Instagram y le dijo: “¿por qué me denunciaste miliquera? (sic), yo nunca te pegue, nunca te vas a olvidar de mi”.
Una hora más tarde, cuando la menor caminaba por la calle Andreotti, el acusado la tomó de los pelos. Sin embargo, en esas circunstancias pasó una mujer que buscó ayudar a la joven y por eso Córdoba la soltó; mientras le expresaba textualmente: “No me denuncies porque te voy a matar”. A posteriori le envió un mensaje por Instagram, manifestándole “dejá de denunciarme miliquera, yo no te hice nada, tu mamá te llena la cabeza, nunca me quiso con vos”.
Lo sucedido fue analizado por Maza en el marco de las leyes de las leyes 26485 de Protección Integral contras las Mujeres y 26061 de Protección Integral de los Derechos de las Niñas, Niños y Adolescentes.
Ello fue así “teniendo en cuenta la edad de la víctima al momento de los hechos y la circunstancia de haber ocurrido en un contexto de violencia de género, que se evidenció no solo de la relación de pareja que ambos mantenían, sino de la espiral de violencia y persecución a la que fue sometida la joven; quien denunció varios hechos de la misma naturaleza ocurridos en días consecutivos, no haciendo caso Córdoba a las mandas judiciales de no entrar en contacto con la damnificada”.
Finalmente, la jueza resaltó que la víctima refirió “hechos anteriores de violencia, ocurridos durante el transcurso de la relación de pareja; todas circunstancias que justificaron el encuadre dado a la luz de las normativas legales mencionadas”.
