El Gobierno Nacional buscará legalizar la tenencia y autocultivo de marihuana en 2020

“La solución no es andar persiguiendo a los que se fuman un porro”, había declarado Alberto Fernández en junio de 2019, a poco días de haber anunciado su candidatura. Hoy, ya en la presidencia, el gobierno de Fernández está trabajando en un proyecto de ley para la despenalización del autocultivo y consumo de marihuana.

Desde el gobierno nacional dejaron entrever que no hay apuro para mandar el proyecto al parlamento, pero la idea es que se debata en el corriente año. El Ministerio de Seguridad es el que está impulsando y trabajando más intensamente en este tema. La Ministra Sabina Frederic, a cargo del area de Seguridad, comentó que el objetivo del proyecto en el que trabaja el Ejecutivo es dejar de criminalizar el consumo desactivando las detenciones de “perejiles” en causas que le generan un fuerte gasto de de recursos al Poder Judicial.

El Poder Ejecutivo está analizando los modelos de regulación que han sido implementados en otras partes del mundo, sobre todo los casos de Canadá, Uruguay, y los 11 estados donde se ha legalizado en Estados Unidos. El Gobierno Nacional busca el consenso de diferentes actores sociales ( (desde las agrupaciones cannábicas hasta la Iglesia) y, a pesar de que la prioridad sería la tenencia y el autocultivo, no descartan que en el proyecto se incluyan otras formas de acceso a la sustancia, como los clubes de cultivo o la venta minorista.

La marihuana es la tercera sustancia psicoacticva más consumida en Argentina después del tabaco y el alcohol. El 80 por ciento de los apresados tienen menos de cinco gramos al momento de ser detenidos. El Estado gasta un millón de pesos quincenalmente en operativos para el secuestro de cannabis.
