Un empleado municipal fue condenado a 18 años de prisión por abusos sexuales en perjuicio de cuatro hermanitas. La sentencia fue dictada por el juez de audiencia santarroseño, Gastón Boulenaz, y las víctimas, al momento de los hechos, tenían entre 6 y 10 años.
Las agresiones –que fueron reiteradas– ocurrieron en las casas del acusado y de las niñas, ya que el victimario concurría asiduamente al domicilio de ellas y viceversa, debido a que era amigo de la familia.
El imputado, de 39 años, fue hallado culpable de cuatro hechos y, por lo tanto, autor de los delitos de abuso sexual de una menor de 13 años de edad, gravemente ultrajante por las circunstancias de realización y acceso carnal como delito continuado; abuso sexual de una menor de 13 años de edad, gravemente ultrajante por las circunstancias de realización como delito continuado; abuso sexual simple de una menor de 13 años; abuso sexual de una menor de 13 años, gravemente ultrajante por las circunstancias de realización y acceso carnal como delito continuado; concursando todos materialmente entre sí.
Boulenaz, además, en la parte resolutiva del fallo ordenó que se mantenga el arresto domiciliario, con tobillera electrónica, y la prohibición de cualquier tipo de contacto del acusado con las víctimas hasta que la sanción quede firme; según lo dispusiera oportunamente el juez de control, Gabriel Tedín, a requerimiento de la fiscala Verónica Ferrero, de la querella –representada por la defensora oficial Carolina Muñoz– y de la asesora de Niñas, Niños y Adolescentes, Graciela Massara.
Una vez que la sentencia quede firme, indicó Boulenaz, deberá efectivizarse el encierro en una dependencia policial o del Servicio Penitenciario Federal, de acuerdo a la disponibilidad existente.
Durante el juicio oral, que se desarrolló en una jornada, declararon la madre de las niñas, que formó parte del proceso como querellante particular, y cinco testigos. Las damnificadas prestaron testimonios a través de Cámara Gesell.
Agravantes
En los alegatos finales, Ferrero requirió los 18 años de prisión y que la prisión domiciliaria se mantenga hasta que el fallo quede firme para evitar una posible fuga en caso de que deba cumplir la sanción de manera efectiva. Dijo que si bien el acusado no tiene antecedentes, hubo cuatro víctimas y tres fueron “gravemente ultrajadas”. Muñoz, en nombre de la progenitora, adhirió al planteo del Ministerio Público Fiscal.
Por su parte, el defensor particular Simón Barreto alegó por la absolución. Subsidiariamente, en caso de declararse culpable al empleado, solicitó la pena mínima en suspenso o si fuese efectiva que pudiera seguir bajo el régimen de arresto domiciliario pues adujo que contribuye a la crianza de dos hijas menores de edad con trabajos de chapa y pintura.
Al concluir el juicio y otorgársele la palabra final, el agresor dijo que no se hacía cargo de las acusaciones y pidió perdón porque también es padre.
Boulenaz, para fundamentar la pena, evaluó como único argumento favorable al reo su falta de antecedentes penales registrables y que con su trabajo se procura el sustento. En cambio consideró como agravantes las edades de las niñas, ya que “en pleno proceso de formación de la personalidad vieron vulnerada de manera grave su integridad sexual”; y la extensión del daño causado, debido a que “casi la totalidad del grupo familiar –excepto un hermanito– sufrió los ataques sexuales, potenciándose de manera negativa los efectos del delito para la familia y en especial para la madre de las niñas, a quien le resulta difícil superar el abuso de todas sus hijas a pesar de los cuidados dispensados a ellas”.
Finalmente, el juez señaló que “los hechos repercutieron de manera negativa en la vida personal y de relación de las víctimas (la progenitora afirmó que mostraron cambios conductuales)” y también valoró negativamente la continuidad de los hechos y “la autodeterminación del imputado, ya que se trata de una persona adulta con experiencia de vida, instruido –tercer año secundario- e incluido socialmente –con trabajo estable como empleado municipal–; de modo que resultaba esperable una mayor grado de reflexión frente a la motivación de la trasgresión de la norma penal”.
