El Ministerio Público Fiscal pidió una pena contra Heraldo Cristian Martín Tarrío de tres años de prisión en suspenso, reglas de conductas –entre ellas que concluya el secundario– e inhabilitación por ocho años para trabajar en talleres mecánicos que requieran autorización, por considerarlo responsable del homicidio culposo de Oscar Juan Moronta.
El hecho investigado ocurrió, en General Acha, el 29 de mayo de 2018, cuando la víctima de 75 años quiso prender una estufa en el garaje de su casa y se produjo una explosión, presuntamente por una pérdida en el tubo de GNC de su vehículo. Moronta murió casi un mes más tarde, el 24 de junio, a raíz de las lesiones sufridas.
Tarrío, al declarar en la última jornada del juicio oral, afirmó que le llevaron dos veces la Eco Sport. En la primera, calibró el equipo de gas, y en la segunda arregló el manómetro porque estaba fallando. Sostuvo que Moronta le dijo que el manómetro marcaba mal, pero no que perdía el fluido.
También indicó que cuando ingresó a la empresa no realizó cursos, sino que se fue formado desde muy joven y que luego sí participó de capacitaciones de uno o dos días, aunque no específicas de GNC. Agregó que al momento del hecho era encargado de taller de la firma Autogas, que ya no se desempeña más allí, y que actualmente lo siguen llamando para calibrar equipos.
Para el fiscal achense Juan Bautista Méndez y la fiscala Paula Soledad Duscher, el mecánico de 35 años tuvo una conducta negligente ya que días antes de la explosión había efectuado el control y mantenimiento del sistema GNC de la camioneta.
La querella particular, ejercida por el abogado Alberto Pérez, en representación de los dos hijos de Moronta, calificó el presunto delito como estrago doloso, aunque adhirió a la pena requerida por la fiscalía. El defensor particular, Rodrigo Adrián Villa, en cambio, alegó por la absolución del imputado.
El juicio se realizó a distancia, vía Zoom, y fue organizado por la Oficina Judicial santarroseña, por intermedio de Claudia Gatica Velázquez. El juez de audiencia, Andrés Olié, quien condujo el debate desde el Centro Judicial de Santa Rosa, dará a conocer la sentencia el 6 de julio al mediodía.
