Un hombre de 28 años fue condenado hoy a un año y seis meses de prisión de cumplimiento efectivo, por ser autor de los delitos de amenazas agravadas por el uso de arma, en concurso ideal con coacción agravada en grado de tentativa. La víctima fue un jubilado de Catriló.

La sentencia contra Martín Alejandro Amaya fue dictada por el juez de control santarroseño, Carlos Matías Chapalcaz, en el marco de un acuerdo de juicio abreviado presentado por la fiscala Cecilia Martiní, la defensora oficial Silvia Mariel Annecchini y el propio imputado, quien aceptó su culpabilidad y permanece detenido desde hace más de tres meses. El damnificado, al ser informado sobre los alcances de lo convenido, también prestó su conformidad.

El hecho ocurrió el 21 de diciembre pasado, a la noche, cuando Amaya llegó hasta el domicilio del jubilado y le pidió un vaso de agua. Cuando se lo dio, el acusado sacó de su bolsillo un cuchillo con una hoja de 25 centímetros de largo. Con el arma le apuntó y lo obligó a ingresar a la vivienda, diciéndole “entrá para la cocina y sentate, acá vamos a hablar”.

Inmediatamente Amaya cerró puertas, ventanas y cortinas para que no se viera desde afuera y, mientras continuaba exhibiéndole el cuchillo, le dijo a la víctima: “a mí no me importa matar a nadie, si mato a uno o mato a dos me da lo mismo”. Luego le preguntó si tenía dinero y finalmente le manifestó: “bueno, te voy a pedir un favor, me tenés que sacar del pueblo ya”.

En ese momento, ambos salieron de la casa, ocasión que el damnificado aprovechó para alejarse y pedirle auxilio a un vecino.

“No obstante contar con el reconocimiento realizado por el imputado, al suscribir el acuerdo de juicio abreviado, posteriormente ratificado en la audiencia de visu, considero que el hecho quedó debidamente probado a raíz de la descripción sobre las circunstancias de modo, tiempo y lugar brindados por el damnificado en su denuncia, lo descripto por personal policial en el parte de novedades, la declaración testimonial brindada por el vecino,  el croquis demostrativo del lugar del hecho, el acta de secuestro del cuchillo, las tomas fotográficas, y el acta de reconocimiento del elemento secuestrado por parte de la madre de Amaya”, señaló Chapalcaz en el fallo.

Por último, el magistrado dispuso que se consulte a la víctima si quiere ser informada acerca de algún beneficio que pueda recibir el acusado antes de completar la condena (salidas transitorias, libertad condicional, prisión domiciliaria, etc.).​
