La Pampa es la segunda provincia en tener una Comisión de Ética

La Comisión de Ética del Poder Judicial realizó la primera reunión con sus miembros titulares, el actual presidente del Superior Tribunal de Justicia, Eduardo Fernández Mendía; la exjueza Elvira Rossetti y el exjuez Abel Bartolomé Rafael Depetris. Allí se aprobó el reglamento interno de organización y funcionamiento y se designó a Rossetti como presidenta del cuerpo.

La Comisión de Ética fue creada por el STJ, el pasado 28 de octubre a través del acuerdo 3747, en el marco del compromiso del Poder Judicial de La Pampa para el fortalecimiento de los principios éticos receptados en el Código Modelo Iberoamericano de Ética Judicial, al que el propio Superior Tribunal adhirió por intermedio del acuerdo 3408.

El organismo está compuesto por tres magistrados del Poder Judicial –en servicio activo o jubilados– que ejercen sus funciones ad honorem. A su vez también fueron nombrados tres magistrados suplentes (la ministra del STJ, Elena Victorica Fresco, y los exjueces Tomás Esteban Mustapich y Alberto José Maza). Por ello, próximamente, la Comisión sesionará en pleno, con la inclusión de ellos.

Asimismo, el cuerpo cuenta con un correo electrónico  (comisiondeeticajudicial@lapampa.gob.ar), al que podrán enviarse las consultas formuladas por los integrantes del Poder Judicial sobre interpretación y aplicación de los preceptos éticos que integran la parte primera del citado Código.

El acuerdo 3747 especifica que uno de los tres miembros debe ser propuesto por los colegios o asociaciones que nucleen magistrados y funcionarios del Poder Judicial –en este caso, Depetris– y, además, “asegurarse la diversidad de géneros” en la integración de la Comisión.

Sus facultades son: a) evacuar consultas formuladas por los integrantes del Poder Judicial, sobre interpretación y aplicación de preceptos éticos consagrados en la parte I del Código Modelo Iberoamericano de Ética Judicial, en relación a casos concretos; b) promover la difusión, conocimiento y participación en foros de discusión en materia de principios de ética judicial; y c) proponer al Superior Tribunal de Justicia acciones o reformas normativas en lo concerniente a la materia de la ética judicial. Cuando la Comisión reciba alguna consulta, deberá emitir su dictamen en un plazo máximo de 30 días hábiles.

Con esta iniciativa, La Pampa pasó a ser la segunda provincia en formar una comisión o tribunal de ética propio, ya que hasta ahora solamente Córdoba contaba con un organismo de consulta para magistrados y funcionarios.​
