Rio Atuel: Ziliotto pide la implementación inmediata de un caudal mínimo

El gobernador Sergio Ziliotto elevó a la Corte Suprema de Justicia de la Nación un escrito pidiendo que “defina La creación del organismo de cuenca correspondiente (CIRA) con facultades plenas y la incorporación efectiva del Estado Nacional para la gestión conjunta de los recursos hídricos de la cuenca del río Atuel.

Asimismo reitera el pedido que implemente  de “inmediato” un caudal mínimo permanente e interino de 3,2 m3/s de agua del río Atuel, con una calidad asociada no superior a los 2450 µS/cm, en pos del cese del daño ambiental existente.   El escrito remitido al máximo órgano judicial de la nación surge de un informe elaborado por la delegación pampeana en la CIAI, en el que también se solicita a la Corte que  establezca el “programa de Acciones y Obras anexas para garantizar la sostenibilidad de dicho caudal mínimo y permanente, así como para atender a la progresividad que se determine necesaria, y defina el programa de Monitoreo de la recomposición ecosistémica y obtención de la línea de base ambiental.

El trabajo realizado por los representantes pampeanos ante la CIAI detalla pormenorizadamente los obstáculos puestos por la provincia de Mendoza para llegar a un acuerdo razonable, asegurando que mantiene una “postura intransigente que no aporta a la solución de este conflicto, sin una visión solidaria que entienda el concepto de integralidad, desarrollo sustentable y al ambiente como un usuario de la cuenca”.

El documento también pone en conocimiento de la Corte el trabajo realizado en el plazo otorgado mediante la sentencia emitida el día 16/07/2020, en la cual se ordeno a las provincias a que, junto con el Estado Nacional, determinen en la órbita de la C.I.A.I. las acciones u obras de infraestructura necesarias para alcanzar el caudal mínimo permanente de 3,2 m3/s, y, diagramen un programa de monitoreo permanente que permita el control en el tiempo, de la provisión del caudal mínimo fijado y de la evolución de la biota, la salinidad y los niveles freáticos.

El escrito fue elaborado por Néstor Lastiri, Romina Belén Schmidt, Fabián Titarelli, Hernán Pérez Araujo, José Vanini, Pablo Dornes, Gastón Buss,  Martin Berhongaray, Roberto Daniel Rodríguez, Héctor Eduardo Gomez, Espartaco Marín, Griselda Ostertag, Jorge Scarone, Juanita De Ugalde, MARÍA Virginia Riestra, María Valderrama Calvo, Julio Rojo y Eduardo Alberto Mangas, todos ellos delegados por La Pampa ante la CIAI.

El informe detalla con exactitud lo acaecido en las reuniones llevadas adelante para el cumplimiento del fallo así como las razones por las cuales no se pudo arribar a un acuerdo y por tanto lograr la eficacia del mismo.

Dentro de estas razones se expone:

  • Negativa de Mendoza a reconocer en hechos la interprovincialdad del río, oponiéndose a una gestión conjunta y coordinada mediante la consolidación de un órgano de cuenca con facultades para gestionar ambientalmente la cuenca en su totalidad.
  • Negativa por parte de Mendoza a consolidar el CIRA dotándolo de las facultades suficientes para que en su seno se tomen las decisiones de gestión que luego las provincias aplicarán en sus territorios en pleno dominio de su soberanía territorial.
  • Falta de discusión por la provincia condómina de la necesidad de incluir el uso ambiental en las normas de manejo de las represas existentes en el río Atuel. Lo cual conllevó su negativa a discutir acciones con las cuales efectivizar el caudal mínimo permanente.
  • Posición de la provincia condómina de supeditar el caudal mínimo permanente a la realización de obras, las cuales resultan no sustentables e ineficientes para la solución real y permanente del conflicto. No contemplando ninguna de ellas la dinámica natural del río Atuel.   
  • Restricción por parte de la Provincia de Mendoza de la extensión areal a monitorear y por ende, a recomponer, limitándola en su extremo inferior hasta la localidad de Algarrobo del Águila, a escasos kilómetros al sur del límite interprovincial.
  • Oposición de la Provincia de Mendoza a considerar la cuenca en su integralidad.
  • La Provincia de Mendoza sigue argumentando que el cambio climático afectará solo a las actividades que se realizan en el área de riego y antojadizamente razona que la extensión de sus efectos está determinada por límites políticos.
  • La delegación mendocina continúa asumiendo que el cambio climático es un factor exógeno, donde las actividades realizadas en su provincia en nada contribuyen al mismo, y por ende la eximen de responsabilidades o de la necesidad de tomar medidas de adaptación (ej. medidas flexibles) a escenarios de cambio.

El plan presentado por La Pampa
 La provincia de La Pampa presento un plan de acciones mediante las cuales podría obtenerse el caudal mínimo permanente y de calidad necesario para detener el daño ambiental en el noroeste de la provincia. Dicho plan de acciones fue rechazado por Mendoza.

Los postulados técnico-jurídico-ambientales manifestados por la delegación pampeana fueron ignorados y desconocidos por los representantes del estado Mendocino, prueba de tal afirmación son las consideraciones vertidas en la reunión de Comité Ejecutivo del día 11 de diciembre de 2020 donde textualmente expresaron “el enemigo nuestro es la naturaleza que no aporta nieve no aporta agua”.

Se vislumbra que la provincia de Mendoza mantiene una postura intransigente que no aporta a la solución de este conflicto, sin una visión solidaria que entienda el concepto de integralidad, desarrollo sustentable y al ambiente como un usuario de la cuenca. Contrariamente, continúa acumulando agua en los embalses y haciendo un uso unilateral, exclusivo y arbitrario del agua.
